1. Scope

These Terms of Service apply to the use of the mobile application "Nami" (hereinafter "App"), provided by z5e, Yannik Zuehlke, Grete-Zabe-Weg 15, 22081 Hamburg, Germany (hereinafter "Provider").

By using the App, you agree to these Terms of Service. If you do not agree with these terms, please do not use the App.

2. Subject Matter

Nami is a habit-tracking app that helps users build and track habits. The App is available in a free basic version and an extended premium version ("Nami Pro").

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable license to use Nami for personal use on your personal devices.

This license allows you to install and use the App for personal, non-commercial purposes. You may not redistribute, rent, or use the App for commercial purposes.

4. Registration and User Account

No registration or user account creation is required to use the App. All data is stored locally on your device.

5. Billing and Purchases

Nami Pro is offered as a lifetime in-app purchase through Apple StoreKit. By purchasing, you acquire an unlimited license to use the premium features.

• Payment processing: Apple manages payment processing through the App Store.
• Refunds: Apple handles refund policies through your App Store account. Please contact Apple Support directly for refund requests.
• Pricing: Displayed prices include applicable taxes.

6. Intellectual Property

All app design, branding, source code, and related materials are protected by copyright and remain the property of the Provider unless otherwise stated by law. All rights not expressly granted are reserved.

7. User Obligations

You agree to use the App only in accordance with applicable laws and these Terms of Service. In particular, you may not decompile, reverse-engineer, or otherwise extract the source code of the App, except to the extent expressly permitted by law.

8. Availability

We strive to keep the App available at all times but cannot guarantee uninterrupted availability. Maintenance, updates, or technical issues may lead to temporary limitations.

9. Limitation of Liability

To the maximum extent permitted by law, Nami is provided "as is" without warranties. We make no guarantees regarding the App's availability, error-free operation, or fitness for a particular purpose.

We are not liable for indirect, incidental, or consequential damages, or lost profits, to the extent permitted by law. This does not apply to damages from injury to life, body, or health, or in cases of intent or gross negligence.

10. Privacy

Information about the processing of personal data can be found in our Privacy Policy.

11. Changes to the Terms of Service

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes in an appropriate manner. Continued use of the App after changes to the terms constitutes acceptance of the modified terms.

12. Termination

You can stop using Nami at any time by deleting the App from your device. We reserve the right to update, modify, or discontinue features as needed.

We may restrict or terminate your access to the App if you violate these Terms of Service.

13. Right of Withdrawal

For digital content not supplied on a tangible medium, the right of withdrawal expires once the Provider has begun performance of the contract, provided the consumer has given express consent and acknowledged that they lose their right of withdrawal upon commencement of contract performance (Section 356(5) BGB).

14. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR). We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration body.

15. Governing Law

These Terms of Service are governed by the laws of the Federal Republic of Germany. Place of jurisdiction is Hamburg, to the extent legally permissible. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
